SIR EDWARD ALSTON v. SIR THOMAS HAMPSON & others.
Chancery Proceedings before 1714. Collins 175.
Bill, 16 May 1665, by Sir Edward Alston of East Barnet, Kt., v. Sir Thomas Hampson and Dame Mary his wife,
Nicholas Glynn and Gertrude his wife, and William Alston.
One Anthony Denny of Orleigh in the parish of Buckland Brewer, Devon, Esq. deceased, was seised of the manors of Orleigh, Playstowe &c. co. Devon, and died about 23 years since leaving all the premises to descend to his daughters and co-heirs, viz., the defendants Mary and Gertrude, and Elizabeth, afterwards wife of William Alston, orator's eldest son. Which Elizabeth, in consideration of a projected marriage between herself and the said William, did by indenture of August 1656 settle her third upon Orator and his heirs, with the condition that if L2500
were paid Orator on 28 October 1657, and another L1000 within 5 years after the marriage, the deed should then be void. Orator settled a jointure in Northants upon the said Elizabeth. In Michaelmas term 1655 Sir Thomas Hampson and others, sued his wife's two sisters under an alleged settlement of the manors made 23 February 1654/5.
Orator has never received full assurance of the said conveyance, free from equity of redemption unless the said
L3500 be paid.
Elizabeth Alston died about 4 June 1664, leaving issue only 3 daughters viz. Gertrude, Hester and Elizabeth, who are all since dead.
Defendants will neither pay the sum aforesaid to Orator, nor assure his title.

HAMPSTON v. ALSTON.
Bill, 28 May 1666, by Sir Thomas Hampson of Taplow, co, Bucks. bart., and Dame Marie his wife, Nicholas Glynn of Glynnford, co. Cornwall, esq. and Gertrude his wife, v. Sir Edward Alston of East Barnet, Kt, and William Alston, esq. his son.
The complainants Marie and Gertrude are daughters of Anthony Dennys of Orleigh in tbe parish of Buckland Brewer, Devon, esq. deceased, who died about 24 years since, leaving as his daughters and coheirs the said Marie and Gertrude, and one Elizabeth, afterwards wife of the defendant William Alston.
By deed of 6 August 1656 the said Elizabeth settled her third share of the Dennys estate on the said William, but the settlement was to become void if her marriage portion of L3,500 were punctually paid to Sir Edward Alston.
The marriage was solemnized about 20 August 1656, and Sir Edward settled an annuity of L400 on the said Elizabeth. No part of her portion was paid, whereby the above mortgage on her third became forfeit.
Sir Thomas Hampson and his wife, and Robert Alston and others, previously sued the complainant Gertrude with regard to the division and settlement of the property, in this court.
Sir Edward believes that his son has sold the reversion expectant of part of said mortgaged estate which will be his after Sir Edward's death.
Sir Edward and his son and the said Elizabeth, have all joined in granting leases etc. of the property.

Manor of Strixton.
It seems probable that Margaret Smyth was the widow of Richard, that he was a connexion of Philip Smyth, mentioned in 1588, and that this conveyance was in preparation for a transaction with the Wisemans, who held a lease of Strixton property. Sir John Lambe, Chancellor of the diocese of Peterborough and Dean of the Arches (a persecutor of recusants and nonconformists, against whom petitions in parliament were presented in 1621 and 1624), had prosecuted John Wiseman and his wife Frances in 1615 for profanation and dilapidation of the church of Strixton, and for marriage within the prohibited degrees. Wiseman stated he was not bound by his lease to repair the church but had done so several times, and the court found the charges groundless, Lambe prosecuting merely for the sake of molestation. (fn. 43) In 1642-3 Elizabeth Wiseman was dealing with a moiety of the manor and advowson of Strixton, which she conveyed to William Wiseman. (fn. 44) In 1647 a conveyance of the whole manor and advowson was made to her by Sir Andrew Jenour, bart., and Margaret his wife, John Gage and Elizabeth his wife, and Richard Binglye and Frances his wife, with warranty against the heirs of Margaret, Elizabeth, and Frances, (fn. 45) apparently Wiseman ladies. Ten years later it appears as held by the Alston family, and a fine was levied of the manor and advowson, by Edward Alston, esq., and Hester his wife, John Alston, esq., and Dorothy his wife, Edward Alston, M.D., and John Wayne, gent., who conveyed them to Sir Thomas Alston in 1656. (fn. 46) According to Bridges Sir Edward Alston of East Barnet on his death in 1682 bequeathed the manor and advowson to his eldest son William Alston, (fn. 47) who presented in 1681 and 1688; and William, dying s.p. in 1690, bequeathed them to his third brother Charles Alston, D.D., Vicar of Northall and Archdeacon of Essex, by whom they were sold to his sister Catherine widow of John Wiseman (who presented in 1707), passing from her to her daughters Hester and Elizabeth Wiseman, (fn. 48) who presented to the church in 1721 and 1723. (fn. 49) Before 1753 the presentations show that the advowson, and presumably the manor, was in the hands of John Spencer of Althorp, and since that date the Earls Spencer have been lords of the manor and sole landowners.
