SIR EDWARD ALSTON V. HARDY & others.
Chancery Proceedings before 1714. Collins 176,
Bill 12 April 1665, by Sir Edward Alston of East Barnet, co.
John Brookes Hertford. v, Richard Hardy, Henry Davy and
In the year 1652 Orator apprenticed his son Thomas to one Henry Davy of the city of London, merchant, giving Davy a bond in L1000 for his faithful service. Thomas served Davy for 3 years, and by his cares and industry very much increased the said Davy's estate, insomuch that Davy found him capable of managing his whole affairs, and about 1655 acquainted your Orator that he intended to send the said Thomas to Smyrna as his factor, and desired Orator to supply his said son with a sum of money to trade on his own account. Thomas managed his master's affairs at Smyrna for two years, and fell sick of the sickness whereof he died, appointing Richard Hardy of London, merchant, his trustee to manage his affairs. John Brookes, Davy's brother in law, was partner with the said Alston ; the defendauts conspire together with regard to settlement of said Thomas's estate.

DAVY v. ALSTON.
Bill, 15 November 1666, by Henry Davy of London, merchant, v. Sir Edward Alston of East Barnet, Middlesex, Knight.
In 1651, at the special instance of the defendant, complainant took one Thomas Alston, son of Sir Edward, to serve him as an apprentice. Thomas lived with and served complainant in England for about 41/2 years ; about 1656, (April), complainant sent him as his factor to Smyrna. There Thomas died and of part of the goods in his hands at that time, complainant has never received account or satisfaction.
In his answer (amongst other particulars as given in previous suits) Sir Edward says that the complainant, his wife and daughter, received mourning for the said Thomas, which cost the defendant L17.

HARDY v. ALSTON.
Bill, 17 May 1670 by Richard Hardy of London, merchant, v. Sir Edward Alston and his son Edward.
On the death of Thomas Alston, son of Sir Edward (at Smyrna) orator took charge of his goods, as requested by the deceased, and assisted Edward Alston, brother of the deceased, then residing at Smyrna, in every way possible.
Sir Edward, having got sundry books and papers into his hands, now pretends that the orator was indebted to the estate of deceased, which is not the case, though he cannot prove it
without production of the papers in question.
