CLERKE v. ALSTON.
Bill, 13 February 1689/90, by John Clerke of Steeple Bumpsted, co. Essex, gent., v. John Alston.
Complainant is lord of the manor of Wethersfield, co. Essex, of which the defendant, John Alston of Sible Hedingham, gent., holds certain lands called Hacksalls, the rent of which is in arrears for eight years, Defendant denies he holds any such lands, and hath removed the ancient dooles or fences, so that complainant cannot distinguish these lands and distrain. He has also got into his possession deeds and evidences belonging to the said manor, kept by complainant in a trunk in a mansion house in Wethersfield, called the Brooke.
Defendant in his answer, dated 5 May 1690, says he holds a messuage and land called Hackshalls, but hath never heard they were at any time held of the manor of Wethersfield, and denies that he ever took the deeds, &c.
He occupied the house called the Brook for about three years, which he hired of Dr. Benjamin Clerk, brother and heir of Joseph Clerk, Esq., then late deceased.

ALSTON v. EVENS.
Bill 8 December 1691, by John Alston of Wethersfeild, co. Essex, yeoman, v. Henry Evens and Dorothy his wife. In A.D. 1680 and for many years past the Orator was well and conveniently settled in a small farm in Wethersfeild, in which he lived very plentifully and supported himself and family in good credit and reputation, and might have continued so, and in all likelihood increased his substance, but it so happened in 1689 that Dorothy, now wife of Henry Evens, then wife of . . . . . Caslicke decd., late of Wethersfeild, gent., taking notice of Orator's good management in the said farm, did importune him to leave his own farm and come to the farm where they then lived, alleging that her husband was very sickly and infirm, and incapable of managing it to the best advantage ; that Orator should have it a great pennyworth, and be amply compensated in case he made any loss.
Orator accordingly took the said farm called Bodwell for a term of 9 years, paying L20 for the first year and L40 a year for the remaining years. The said Mr. and Mrs. Caslicke still continued to inhabit a part of the house, alleging the husband's sickness, but they never made a proper lease to Orator, who has made many improvements, By living in the house the said Dorothy had opportunity to come by the informal agreement, which she retains, and refuses to execute the promised lease.
