General Notes:
The Will of Dorothy Warner 24 Feb 1696 gives Mary the authority to dispose of her estate, which included the estate of Mary Alston of Moulsey, vested in Trustees Thomas Alston of Chelsea and Bambridge Buckeridge.
ACTON v ALSTON & OTHERS Mitford. 137/1 Bill, 11 June 1659, by John Acton the elder of Bramford, co. Suffolk, Esq. v. Mary Alston, the mother of John Hanmer and Mary his wife, Peter Alston and John Clayton. Complainant is Lord of the manor of Bramford ; one Joseph Alston of co. Suffolk, Esq. decd. and some of his ancestors before him, held land of the said manor, together with other lands near by but not belonging to the said manor. He died about 15 years since, and his estate in lands in the said manor is determined, as would appear by copy of court rolls if they were forthcoming. Since his death his widow Mary, John Hanmer Esq. and his wife Mary, sole daughter and heir of the said Joseph Alston, Peter Alston heretofore of Bramford, gent,, and John Clayton, gent., confederate together and pretend that the said Joseph's Estate is not determined. Defendants do not know the extent of the lands held by the late Joseph Alston in Bramford manor, nor whether they are freehold or copyhold, because the complainant has never suffered them to have a sight of the court rolls. John Clayton believes that part of the lands now held by Mary Alston, widow, were formerly held by Peter Alston, father of the defendant Peter, who had besides another son Edward, After their father's death, Peter and Edward were tenants together of this freehold land, paying therefore a rent to the lord of the manor of Bramford. ACTON v. ALSTONE. Whittington. 54 and 468 1662. Bill, 17 June 1662, by John Acton of Bramford, co. Suffolk, esq., son and exor of John Acton, esq. deceased, v. Mary Alston, Sir John Hanmer and Dame Mary his wife, John Clayton and Peter Alston. This is merely a bill of reviver of the suit brought by complainant's father against the same parties, with regard to title to co copyhold lands in Bramford. See Acton v. Alston, Milford 137/1. DADE (sic) v. ALSTON. Bill, 9 February 1663/4 by Thomas Eade (sic) of Tannington, co. Suffolk Esq., John Lambe, William Acton and Nathaniel Acton, all of Barham in the said co., executors of John Acton Esq. In Trinity term 1659, John Acton, father of the said decd., filed a bill against Mary Alston, widow, John Hanmer Esq. and Mary his wife, John Cleyton and Peter Alston ; the complainant was lord of the manor of Bramford, and in his bill shewed that one Joseph Alston, late of Sproughton, Esq. deed., and his ancestors, held copyhold lands of the said manor. Joseph died about 15 years before the date of the bill. His widow Mary, and his only daughter Mary Hanmer, contrived to procure continued possession of the lands, though the Alston title had expired by flux of time, and felled great quantities of wood &c. DAWSON v. ALSTON. Bill, 30 June 1664, by Henry Dawson of Groton, co. Suffolk, gent., v. Mary Alston, Sir John Hanmer and Mary his wife, and Sir John Warner. Complainant is lord of the manor of Sanderford alias Sampford in Great Waldingfeild. At a court of that manor held 23 October 1655 Mary Alston was admitted tenant of a copyhold tenement, now in the occupation of one John Canham. She paid the yearly rent for some years, together with a fine upon her admittance : but now conspires with Sir John Hanmer, of Lincoln's Inn Fields, Kt,, and the other defendants to deny the said tenement is copyhold at all.
