FRYER v. ALSTON. Bill, 24 Oct. 1698, by Elizabeth Fryer [7283], widow of Hamlett Fryer late of Colchester, yeoman, deed., v. Samuel Alston. The said Hamlett made his will in 1697, leaving his property in Stansfield, co, Suffolk, to complainant for life, with remainder, half to her assigns, and half to his own right heirs. Samuel Alstone of London, merchant, is heir at law of the said Hamlett, and threatens to disturb complainant in possession, saying the said Hamlett was not of sound disposing mind. In his answer, Samuel Alstone does not state his relationship to the deceased, but asserts his rights as in the bill. Hamilton. 115/36. 1698. ALSTON & another v. ALSTON. Bill 12 December 1693, by Samuel Alston of London, merchant, Edmund Alston of London, mariner, (two of the children of Edward Alston late of Newton, co. Suffolk, gent. deed.) and Oliver Andrews of London, linendraper, son and executor of Charles Andrews, late of Sudbury, co. Suffolk, linendraper, v. Edward Alston, clerk, now Rector of Newton, and eldest son and executor of the said Edward Alston decd. The said Edward decd. surrendered his copyhold lands &c. held of the manors of Newton Hall and Butler's in Newton, and Mr. Gurdon's manor in Assington, co. Suffolk (in which co. he also held freehold land) to the use of his will, which he made about 18 November 1680. He gave his plate and half his household stuff to his wife Anne for life, with remainder at her death equally between his sons now complainants, and all his lands to the defendant, charged with the payment of L150 to the said Samuel and L60 to the said Edmund at their several ages of 24. Isaac Alston, complainant's brother, who was to have had a share of the plate, died during his father's lifetime. Their father died about 4 years since, when complainants were both over 24. The complainant Edmund borrowed L43 of the said Oliver Andrews, giving his bond therefor to Charles Andrews decd., and assigning his legacy as security. ALSTON v. ALSTON. Answer, 8 February 1693, of Edward Alston, defendant to the above bill of complaint. Defendant quotes the provisions of his father's will, which was proved in the Bishop of Norwich's court. The goods of deceased were appraised by Bernard Carter and John Cook at L141 9s. 1d. (a copy is attached.) Also a schedule of debts, among which are to Dr. Jorden, 10s. ; for wine at the funeral, L1 18s 0d ; for escutcheon, L1 5s 0d; for testator's coffin, L1 12s 6d ; to my brother Cook for physic and money lent, L11 15s 21/2d. ; to Mr. Chaplin, draper for the funeral, L15 10s 0d; expended in defending the testator's title to his lands before the defendant could administer, L23 0s 0 d ; for repairs of the tenement called Brookes, where the testator lived, before a tenant would take a lease, L18 . Testator left behind a number of debts and mortgages owing ; he owed Suzan Weatherall about L575 under two bonds, which the said Susan by her will gave to this defendant, and to his sister Mary, mother of the complainant Andrews, the said Suzan died in or about 1672. The testator, on the marriage of his said daughter Mary, made a mortgage of his copyhold lands holden of the manor of Newton Hall. ALSTON & another v. BROWNE. Bill, 25 November 1704, by Samuell Alston and Samuell Porter of London, merchants, v. Jane and Edward,Browne. Orators and one John Fenn for several years before the year 1693 were co-partners in the way of merchandizing and factors for other merchants, and in the course of their business had occasion to borrow sums of money from several persons, especially L200 from the defendant Jane Browne, for which sum the Orators gave her a bond 9 June 1693. In consequence of losses by sea, &c, the firm became unable to pay their debts, and found on examination they could not pay more than 7/- in the pound. The defendant Edward Browne, brother of Jane, was likewise their creditor, and agreed to the composition ; but he now joins with her, and they are prosecuting in the King's Bench for the full sum of the penalty of the bond. ALSTON v. JONES. Bill 13 June 1691, by Samuel Alstone of the parish of St. Giles's in the Fields, co. Middlesex, gent., v. Thomas Jones, citizen and apothecary of London. In August 1689 Orator borrowed L50 from defendant, giving his own bond as security and also a note for L60 under the hand of one John Whitley, payable some short time after to Orator. SALTER v. ALSTON. Whittington, 261. Bill, 21 January 1701/02, by Henry Salter of Lincoln's Inn, CO. Middlesex, gent. v. William Mudford and Samuel Alstone. Complainant was employed as an attorney by the defendant Mudford, of Culhampton, co. Devon, wool merchant, and on delivering his bill Mudford referred him for payment to defendant Alstone, who had goods, &c., of the said Mudford in his hands. Now both Alstone and Mudford conspire to defraud complainant of payment. Samuel Alstone (undescribed) in his answer denies every allegation of the bill.
