HULL v. ALSTONE.
Bill, 16 June 1691, by Joseph Hull, of Stoke next Nayland, Suffolk, esq., v. Sarah Alstone, late of Harwich, now
of Brentwood, co. Essex, spinster.
In 1687 complainant borrowed L50 at 5% from the defendant, through one Mr. Thomas Ruse of Colchester, attorney, giving a penal bond as security.
He has several times offered to pay both principal and interest, but the defendant refuses to receive it.
Defendant, in her answer, says she believed at the time of making the loan, that she was lending the money at 6%.
The bond has been in the custody of her friend, Mr. Haveringill, at Colchester.
