Answer, 23 December 1698, of Dame Temperance Alston, widow, one of the defendants to the bill of complaint of Crew Alston, Rowland, Horatio, Elizabeth, Vere, John and Anne Alston, all infants under the age of 21, by the Hon. Charles Montague, Esq., their next friend, and George Nodes, gent.
Sir Rowland Alston made his will and died possessed of a considerable personal estate, but not near so much as in the bill is alleged. After the death of Thomas, Lord Crow, her father, and the Earl of Bolingbroke and Mr. Charles Alston had renounced executorship, defendant took out letters of administration to the estate. The inventory made out by the bailiff was of far too great a sum, and defendant employed an upholsterer, a skilful man,
to make one more correct. (These inventories are appended to the answer).
A sale of grain and some of the husbandry stock and furniture has realised L1892 7s. 8d. Defendant has paid debts &c. to the amount of L1479 5s 7d., and has also laid out several sums for maintaining and placing out the complainants, testator's children,
and the defendant Mary Alston, amounting altogether to L333 15s. etc.

ALSTONE v. CREW.
Bill, 15 May 1700, by Horatio, Elizabeth, Vere John, and Anne Alstone, sons and daughters of Sir Rowland Alstone, late of Odell, co. Bedford, Bart., all under the age of 21 years, by Dame Temperance Alstone, their mother, v. Anne, Lady Crew.
Orator's grandfather, and Thomas, late Lord Crew, by his will dated 11 July 1696, bequeathed to his granddaughter Mary, eldest daughter of Sir Rowland Alstone, L500, and L100 apiece to his other children.
The defendant, his widow and executrix, refuses to pay these legacies.
Defendant says she cannot safely pay the legacies to Orators, because they are under age.
