In 1965/6 the Manningtree church was demolished and housing built on the site, in the process the grave yard memorials were lost and the deceased exhumed and reburied in Mistly churchyard.

Last Will and testament of Daniel Constable Alston of Little Bromley Essex Gentleman

All freehold and leasehold estates (except those vested in me upon mortgage) to
Edward John Alston of Great Bromley Essex Gentleman and Frederick Wase of Holbrook Suffolk farmer,
their heirs, etc. according to the nature and tenure of the trusts, and for them to make sale and dispose of
my estates as soon as possible following my death as well as the copyhold or customary messuages, lands, etc.
to which I or any person in trust for me may be seized or entitled either together or in parcels and either by
public auction or private contract with full power to buy in and to rescind any contract for sale without being
responsible for any loss etc. and by and out of the money to arise from such sale to pay for my funeral and
testamentary expenses and debts and invest the residue in their name/s in any public stocks or funds of
Great Britain or on government or real security in England with power to vary at their discretion and to hold
the stocks, funds, securities and annual income thereof upon trust for my child/ren who shall attain
the age of twenty-one shared equally. For trustees to use up to one half of any one child's share for their advancement
or benefit, and to apply whole or part of the annual income of a share as they see fit for any child entitled for their
maintenance or education either directly or to his guardian/s and otherwise accumulate the residue (if any) thereof
in the way of compound interest by investing the same and the resulting income thereof to be used the same way.

If no child surviving to attain the age of 21 I give and bequeath the said stocks, funds, monies, shares and
securities or so much thereof as shall not have been vested or applied under the trusts aforesaid to Edward John Alston,
his heirs, etc.

Until all estate shall be sold, trustees to apply the income of that estate to pay those payable
after all rates, taxes, expenses of repairs, insurance, etc. have been paid.

All freehold and copyhold hereditaments vested in me upon mortgage to Edward John Alston and Frederick Wase, heirs, etc.
subject to the equity of redemption subsisting therein respectively but the money secured on such mortgages shall be
considered as part of my personal estate.

I appoint Edward John Alston and Frederick Wase guardians of my children and executors of this my Will and
authorise them to pay any debts owed by me at this time and to accept any composition or security for any debt and
to compromise or submit to arbitration and settle all accounts and matters belonging or relating to my estate and to
act in regard as they shall think fit without being responsible for any loss.

Receipt/s in writing of the trustee/s for the time being acting in the co-execution of any trusts shall fully discharge the
purchaser/s or other person/s paying.

If any trustee shall die or be desirous of being discharged, become incapable to act, etc. then the trustee/s (including
the retiring trustee) may appoint another person to be trustee who is to be given the same powers as the original trustee.

Trustee/s to be chargeable for the time being only with such monies as he/they shall actually receive and shall not be
answerable the one for the other nor for any banker, broker, or other person in whose hands the trust money shall be
placed nor for the insufficiency of any stocks, funds, etc. or involuntary losses. Trustee/s to reimburse themselves for
all expenses incurred in the execution of this my Will.

On the 19th day of July 1860 the Will of Daniel
Constable Alston late of Little Bromley in the County of Essex

Gentleman deceased who died on the fifteenth day of March
1860 at Little Bromley aforesaid was proved in the District
Registry attached to Her Majesty's Court of Probate at Ipswich
by the oaths of Edward John Alston of Great Bromley Essex
Gentleman and Frederick Wase of Holbrook Suffolk farmer the
executors having been first sworn duly to administer - effects
under £7,000 - extracted by C. S. Owen

(Susannah WASE [3916] was born in Bruisyard SFK, baptised on 7 Sep 1815 in Kettleburgh, Suffolk, died on 4 Oct 1855 and was buried on 10 Oct 1855 in Manningtree SFK.)
