1. Robert Charles Torlesse: Will, 18 Jun 1952. THIS IS THE LAST WILL AND TESTAMENT of me ROBERT CHARLES TORLESSE of Papakura in the Dominion of New Zealand Bank Officer. 1. I REVOKE all wills and testamentary dispositions at any time heretofore made by me. 2. I APPOINT my brother JOHN HENRY TORLESSE of Rotorua Bank Manager (hereinafter called my trustee) to be executor and trustee hereof. 3. I APPOINT my said brother JOHN HENRY TORLESSE to be the guardian after my death of my two children CAROLYN PATRICIA TORLESSE and ROY ROBERT TORLESSE. I GIVE DEVISE BEQUEATH AND APPOINT the whole of my property both real and personal of whatsoever kind and wheresoever situated unto my trustee upon trust after payment thereout of my just debts, funeral and testamentary expenses and succession duties for my children in equal shares absolutely 5. WITHOUT negativing or limiting in any way the powers reposed in my trustee by statute or otherwise I give to my trustee the following powers namely:- (a) TO SELL all or any part of my real and personal estate either by public auction or private contract or in such manner and subject to such terms and conditions as my Trustee shall in his absolute discretion think fit. (b) NOTWITHSTANDING any trust for sale hereinbefore contained To Postpone the sale calling and conversion of my real and personal estate or any part thereof for so long as he thinks fit notwithstanding that it aay be of a wasting speculative or reversionary nature. TO APPLY the whole or any part of the capital and income of the vested or contingent share of any child of mine under this my will for or towards the maintenance education advancement or benefit of such child during his or her minority with liberty to pay the same to the guardian or guardians of such child for the purposes aforesaid without being liable to see to the application thereof. IN THE SUPREME COURT OF NEW ZEALAND CANTERBURY DISTRICT CHRISTCHURCH REGISTRY IN THE ESTATE of ROBERT CHARLES TORLESSE formerly of Papakura but late of Christchurch, Bank Officer, deceased. I, JOHN HENRY TORLESSE of Rotorua, in the Dominion of New Zealand, Bank Manager make oath and say as follows:- 1. THAT I knew ROBERT CHARLES TORLESSE formerly of Papakura in the Dominion of New Zealand but late of the City of Christchurch in New Zealand aforesaid Bank Officer now deceased when alive and that the said Robert Charles Torlesse was resident or was domiciled at Christchurch aforesaid within this judicial district and that the nearest Registry Office of this Court to the place where the said Robert Charles Torlesse resided or was domiciled is at Christchurch aforesaid. 2. THAT the said deceased died at Dunedin in New Zealand aforesaid on or about the 20th day of July One thousand nine hundred and fifty-three as I am able to depose from having been present at his funeral. 3. THAT I believe the partly typewritten and partly written document now produced bearing date the 18th day of June One thousand nine hundred and fifty-two to be the last will and testament of the said deceased and that I am the Executor therein named. 4 THAT I will faithfully execute the said will by paying the debts and legacies of the said deceased so far as the property will extend and the law binds and will when ever ordered so to do after the grant of probate to me file in this Court and verify by affidavit a true full and perfect inventory of all the estate effects and credits of the said deceased which shall have come into my hands possession or knowledge and also a full distinct and proper account of my execution of the will which shall set forth the dates and particulars of all receipts and disbursements and show which of the same are in my opinion on account of capital and on account of income respectively. 5. THAT according to my knowledge and belief the estate and effects of the said deceased in respect of which Probate is sought to be obtained are under the value of £8,000 (Eight thousand pounds).
