That Robert [427] had a son Robert and Thomas etc is confirmed by this will however several entries in the Harwich Baptism Register show Robert & Sarah's surname as Liven.

I this day received of my brother Thos Liveing the writings (?) of my houses in the Church Street which I had intrusted in his care and . . . . . vise a Bond for Two Hundred Pounds

1. Robert Liveing: Receipt and Discharge for Legacy from his father Robert Liveing [427], 19 Jul 1785, Harwich.
To all to whom these presents shall come I Robert Liveing of Harwich in the County of Essex Gentlemen (eldest son of Robert Liveing late of Harwich Gentlemen deceased) send greetings Whereas the said Robert Liveing deceased by his last will and testament dated the 17th day of April now last past did bequeath
unto his Executrix and Executor therein and hereinafter named or the survivor of them all the executors or administrators of such survivor All and every the fishing or coasting smack and smacks or vessel or vessels which he should die possessed of or entitled unto with the masts sales saleyards anchors cables ropes cords tackle apparel furniture boats oars and appurtenances whatsoever which at his decease should thereunto belong Also all his household goods plate china linen woollen furniture and other goods chattels ready money securities for money mortgages bonds notes stock in the public funds and all the estate both real and personal which he should be possessed of interested in or entitled unto at the time of his decease (not therein before by him specifically disposed of) Upon Trust that they should dispose (for the best price that could be gotten) of the said personal estate as should not consist of monies or security for money And should call receive and get in all such parts thereof as consisted in monies and securities for money And Upon Trust to invest layout or place at interest the sum of £330 part of the money to arise as aforesaid for the benefit of his grandson and grand daughter therein named as therein directed And upon further trust that they his said Executrix and Executor (after payment of his just debts funeral expenses is the charges of proving or otherwise concerning his will and the investment of the said sum of £330 and payment of the specific legacies therein before given) should pay all the residue and remainder of the monies which should arise by such sale or sales and to be called received and got in as aforesaid unto and amongst his sons the said Robert and Thomas and his daughter Martha to whom he gave and bequeathed the same equally to be divided between or amongst us share and share alike if we should survive but if any of us should happen to time for and leave any lawful issue that should survive him he give to such issue the share of his her of their deceased father or mother proportionately And if at any time thereafter he should advance any money to any or either of us which he should endorse upon the back or cover of his said will That then such sum or sums so set down in writing should be considered and taken as part of the share of his personal estate thereby given him her or them and go in part of his her on their share or shares to whom the same should be given or advanced And the said Testator appointed his said daughter Martha Saunders and his son Thomas Liveing executrix and executor of his said will And whereas the said testator died on the 28th day of April last past and the said Martha Saunders and Thomas Liveing duly proved the said Will in the prerogative Court of Canterbury and have taken upon them the execution thereof And having sold and disposed of such parts of the said testator's personal estate and effects which did not consist of money or securities money and were not in the said Will specifically disposed of and call and got in such part thereof as consisted in money and securities for money have paid and discharged all the said testator's just debts funeral expenses and the charges of proving and otherwise concerning the said Will And after deducting the sum of £330 so given to Testator's grandchildren aforesaid and the other specific legacies bequeathed by this said Testator in his said Will their did remain the sum of £482.17 shillings and seven pence half penny to be expressly divided between us his said Sons and Daughter And whereas the said Executrix and Executor on the day of the date hereof have paid unto me the said Robert Liveing the sum of £160.19 shillings and 2 pence half penny being one equal third part of the said residue of the said Testator's personal estate and effects.
Now know ye that I the said Robert Liveing son That of the above-named testator have on the day of the date of these presents received of and from the above named Martha Saunders and Thomas Liveing Executrix and
Executor of the said last Will and Testament of my said late father Robert Liveing the sum of £160.19 shillings and two pence half penny of lawful money of Great Britain being full share and third part of the residue of the personal estate and effects of the said Testator the receipt where of I do here by acknowledge and myself to be therewith fully paid and satisfied and of and from the same and all legacies and bequests and all actions suits arrests troubles damages claims and demands whatsoever that shall in anywise happen to arise for or concerning the same or any part thereof I either said Robert Liveing for myself my Executors and Administrators do remise release accept and discharge the said Martha Saunders and Thomas Liveing there and each of them Executors and Administrators for ever by these presents.
In witness whereof I the said Robert Liveing have hereto set my hand and seal this 19th day of July in the year of our Lord 1785.

2. Robert Liveing: Will, 2 Aug 1786, Harwich.
WILL OF ROBERT LIVEING.
This is the last Will & Testament of me Robert Liveing of Harwich, Gentleman being at the time of making thereof in sound mind and understanding.
I give devise and bequeath unto my sister Martha Saunders (wife of John Saunders) and my brother Thomas Liveing my Executrix and Executor my messuage and tenement with part of a washhouse and yard situate on the east side of Church Street in Harwich in the tenure or occupation of my Sister in Law Elizabeth Liveing.
Also all that messuage and tenement adjoining the said above messuage and tenement with the other part of the washhouse and garden situate on the same east side of Church Street aforesaid in the tenure and occupation of John Nunn.
Also all and every other of my Lands Messuage Tenements Goods Chattels ready money mortgages bonds etc etc I devise Upon Trust that they my said Executrix and Executor shall sell and dispose of all the aforesaid as shall not consist of money or securities for money.
And Upon Trust my Executrix and Executor after payment of my just debts and charges lay out at interest or mortgage or other real security or invest as they see fit.
To apply one fourth part of the interest dividends or produce thereof towards the maintenance education and bringing up of my niece Elizabeth Gill Liveing until she shall attain her age of 21 years when she shall be paid one fourth part or share of the principle money aforesaid
To apply one fourth part of the interest dividends or produce thereof towards the maintenance education and bringing up of my nephew William Liveing until he shall attain his age of 21 years when he shall be paid one fourth part or share of the principle money aforesaid.
And as to the remaining two fourth parts of the money to arise as aforesaid I give and devise unto them my said Executrix Martha Saunders and my Executor Thomas Liveing in equal shares and proportions and I make constitute and appoint my said sister Martha Saunders and my said brother Thomas Liveing Executrix and Executor of this my last Will and Testament revoking all former Wills by me I set my hand and seal to it this second day of August 1786
