MARRIAGE.
On the 13th September, at St. John's Church, Brisbane, by the Rev. John Mosely, Thomas Fitzarthur Smythe, to Matilda, relict of the late Captain Frederic Blagg Hampton, K.I.C.

MATRIMONIAL CAUSES JURISDICTION.
Before his Honor Sir James Cookie, Chief Justice.
SMYTHE V. SMYTHE, DIVORCE.
In this case the petitioner, Matilda Smythe, prays for a dissolution of her marriage with the respondent, Thomas Fitzarthur Smythe, on the grounds of desertion and adultery. On the application of the Attorney-General, instructed by Mr. Wilson, the hearing of the case was set down for November 25, before the full Court, without a jury, and no record.
There was no appearance on behalf of the respondent.

Divorces
The evidence in the case of Smythe v. Smythe was then taken. In this case Mr. Blake, Q.C., and Mr. Hely, instructed by Mr. W. H. Wilson, appeared for petitioner, and Mr. Cooper, instructed by Mr. Macpherson, for the respondent. The petition set forth that Matilda Smythe was married to Thomas Fitzarthur Smythe, then a clerk in the Civil Service, on the 13th September, 1860, at St. John's Churoh; Brisbane, and lived with him in Brisbane until the 21st November, 1866, when the petitioner went to Europe with respondent's consent, and returned to tho oolony in the following year. That there were three children issue of the marriage, one of whom, a girl, was living. That the petitioner was 45 years of age and the respondant 34 years of age, and had deserted her in May 1867, and had not contributed to her support in any way, but had sent a few small sums of money to his daughter. Since May 1867, he had been employed at Brisbane as a wine and spirit merchant, and at Gympie as a newspaper reporter. That early in March, 1867, he had committed adultery with one Drucilla Laughter, and had cohabited with her ever since; that in the year 1870 he had left for Melbourne, and Drucilla Laughter had since and was now living with him there as his wife. The petitioner prayed for a dissolution of her marriage and such further relief as the Court might award. Finding - decree absolule, with costs against the respondent.
