MORSE V. ALSTON. Bill, 15 February.1672/3, by Symon Morse, citizen and merchant of London, William Hills and John Lilburne, citizens and grocers of London, v. Thomas Alston, citizen and grocer of London, John Alston the elder, his father, and William Alston, his eldest brother. The defendant Thomas owes debts severally to each of the complainants; but instead of giving them satisfaction, he " absconds himself," and has assigned over his whole estate to the other defendants. They pretend that Thomas was indebted to them by judgment for far more than his estate is worth ; wherefore complainants can get no redress. Mitford. 178/92. 1672/3. Alstoniana Pg 206
MORSE v. ALSTON. Answer, 14 May 1673, of William Alston, gent., one of the defendants to the complaint of Simon Morse and others. Defendant's brother Thomas Alston may have had dealings within the last two or three years in the way of trade with the complainants. In Hilary term 1671 defendant obtained a judgment for L600 against the said Thomas, to prevent one Woodward, citizen and oilman of London (who had taken part of Thomas's estate in execution), from going away with the goods and estate so seized ; at the same time defendant made himself liable for his brother's debts, and has discharged them as far as the said Thomas's estate would allow ; all the defendant could come by was appraised at L328 6s 9d. Mitford. 276/23. 1673. Alstoniana Pg 206
TRACY v. ALSTON. Bill, 3 May 1677, by Paul Tracy of London, gent. v. Thomas Alston of London, merchant. Orator owed defendant Alston a sum of money, and pledged him a parcel of fine cloths to pay this. Owing to non-payment of the money at the appointed time, Alston has sold part of cloth, etc., etc., and refuses to give complainant any account, &c, Whittington, 188, 1677, Alstoniana Pg 207
