PARKER v. ALSTON.
Bill, 10 November 1645, by Augustine Parker of Washbrook, co. Suffolk, gent. v. Mary Alston.
The bill recites orator's reversionary interest &c. under the will of Joseph Alston, decd., of which he is overseer.
Mary Alston, the defendant, his widow and executrix, soon after his death grew weary of abiding in tbe house &c. bequeathed to her for two years and afterward to orator's son, both by reason of the place, and for trouble of occupation thereof, with care of servants ; and she advised with her friends to induce Orator to buy her stock of cattle &c. there. An agreement was made for the purchase ; orator conceived an allowance should be made him out
of the purchase money, for sums due to him from his said late cousin Joseph Alston, and also for the legacy bequeathed to him in the will. The suit arises out of this and other small financial transactions.

BRIGHT v. ALSTON.
Bill, 14 April 1646, by Edmond Bright of Mildenhall, co. Suffolk, a gent. V. Mary Alston, widow, James Withe, and others.
One Joseph Alston of Washingbrooke, Suffolk, decd., was seised of the manor of Shelland, and freehold lands in Boxted &c., besides copyhold tenements held of several manors, and a great personal estate in money and plate &c. He had issue only two daughters, Mary and Susan, and had no brothers, but three sisters, Anne, Susan and Bridget. Anne was married to Mr. Wells, clerk, by whom she had issue a son and a daughter now living ; and at the death of the said Wells, she was married to one Mr. Paine, since dead, by whom she had issue a son now living. Susan was married to complainant, by whom she had issue a son since dead. By his will the said Joseph left bequests to the children of complainant and the said Susan, besides bequests to the children of the said Anne
and Bridget. But Mary Alston, his widow, pretends that, a few days before his death, Joseph made another will by which he left but L20 apiece to the said children ; a year after Joseph's death complainant searched in the Registry at Norwich but could find no such will proved.
Answer of Mary Alston and Thomas Lilly (signed by both) 8 May 1646.
Joseph Alston made a will about 6 months before his death, the provisions of which are unknown to the said Mary, because, when he offered to read it to her, she could not bear to hear it read ; a few days before his death, viz. about 18 December 1643, he made the will which the complainant disputes.
Thomas Lilly was the said Joseph's servant, and attended upon him in his sickness, and witnessed the will made a few days before his death.

WYNN v. ALSTON.
Bill, I January 1655/6, by Thomas Wyn [3014] of London, merchant, v. Mary Alston, widow.
Thomas Alston, one of the sons of Peter Alston, late of Bramford, co. Suffolk, gent. decd., devised messuages and lands in Bramford to complainant and Margery, then his wife (sister of the said Thomas) and their children ; and in virtue of the said bequest they duly entered in, and let the said property. Some time afterwards (about Michaelmas 1630 or 1631) one Joseph Alston, a near kinsman of the said Margery, repaired to complainant's house in London, and there had diet and lodging, and complainant procured him to be admitted to the free school of St, Paul's, London, and furnished him with a gown, books, &c. Joseph was a ward in Chancery, and the Master of the Court of Wards sent for him, and delivered him into the custody of the usher of the said court, who kept him 4 days without any manner of sustenance, so that he would have died, but the complainant sent for him to his own
house again, and provided him with physicians and a nurse for a great length of time; and so the said Joseph
received his health again. Complainant afterwards sent him to the University of Cambridge, until about 1639,
shortly after which the said Joseph married one Mary Warner, daughter of . . . . . Warner, since deceased ; and came of age in 1639 and was in enjoyment of the real and personal estate left by his father and elder brother (which personal estate was valued at L4000 or L5000) ; his elder brother had died under age, a ward to the court. Joseph was very sensible of his debts to complainant, but his wife incensed him against him, to such an extent that the said Joseph knowing the deeds of the late Peter Alston were in the hands of one Francis Andrewes of Hadley, co. Suffolk, by
fraudulent means got possession of them and detained them from complainant, alleging he had deeds that upset complainant's title to the premises abovesaid. He afterwards promised to surrender the deeds, but died about 10 years since, and the said Mary, his widow, still retains them.
Defendant, in her answer, denies all knowledge of the expenses incurred by complainant for her late husband ; if it is as stated the cost should be defrayed by Peter Alston, to whom he was ward. In 13 Chas. I. after a long suit in the court of Wards and Liveries upon a bond of L5000 wherein the said Peter Alston's father stood bound to account for the moneys &c. of Edward Alston, then decd., father of Joseph, the said Joseph obtained a decree against Peter for the payment of L3450, and for non-payment thereof the said Joseph did extend certain lands which formerly belonged to the said Peter's father ; and so the deeds and premises came into his hands.

Devises to her sister Dorothy Warner and her heirs, the Manors, Messuages, Lands Tenements and hereditaments and real estate in any part of England--also to the said Dorothy Warner her ready money, plate, jewells, wearing apparel, debts owing and all personal estate whatsoever.
The said Dorothy Warner appointed full. and sole executrix--All other wills revoked.

Trinity 1649 - Two halves of final concord for L60 between Mary Alston Widow, and Edward Alston [2997] gent and wife Elizabeth of a messuage in Bramford with garden orchard woods and lands totaling 58 acres. Ref. HA61/436/570.
