This Indenture made the first day of May in the year of our Lord One Thousand Seven Hundred and Sixty Four and in the Fourth year of the Reign of Our Sovereign Lord George the Third by the Grace of God of Great Britain France and Ireland King Defender of the Faith and so forth

Between Jedediah Kerie of the Parish of Saint Thomas Middle Island in the Island of Saint Christopher Esquire, Edward Peters of the Parish of Trinity Palmetto Point in the said Island Esquire, and John Mahon of the Parish of Saint George Basseterre in the said Island Gentleman of the one part, and John Phipps of the said Parish of Saint George Basseterre Merchant of the other part

Whereas Christina Edmeads late of the said Parish of Saint Thomas Middle Island in the said Island of Saint Christopher Widow deceased did in and by her last Will and Testament bearing date the Eleventh day of March in the said year of our Lord One Thousand Seven Hundred and Sixty Four among other Legacies and bequests by her given and bequeathed did give devise and bequeath to her Son John Kerie Edmeads after payment of such hereinbefore mentioned Legacies and Bequests All her Rest and Residue of her Estate Real and Personal And in case of his Death before he attained the age of Twenty One years then she gave devised and bequeathed the Estate so given to her Son John Kerie Edmeads to her Brother the said Jedediah Kerie party hereto to hold to him the said Jedediah Kerie during his natural life and after his Death unto and among the children of her late Brother the Reverend John Merac deceased and of her late Brother Ravel Kerie also deceased

And Whereas in and by such last Will and Testament of her the said Christina Edmeads she hath given and granted to her Executors full and absolute power and authority to make sale of all such Remainder of her Estate as well Real as Personal And to give and execute proper and sufficient Deeds and Conveyances in writing for passing the Fee Simple and Inheritance thereof to such person or persons as might chuse thereafter to become purchaser or purchasers in part or in the whole of such residue of her Real and Personal Estate and the money arising from such Sale to put out to Interest on good and sufficient landed security And of that her said last Will appointed the said Jedediah Kerie Edward Peters and John Mahon Executors relations being to the said Will had may more fully and at large appear

And Whereas since the decease of the said Christina Edmeads he the said John Phipps party hereto hath contracted and agreed for the purchase in Fee Simple of a certain piece or parcel of land scituate lying and being in the Town of Old Road in the said Parish of Saint Thomas Middle Island in the Island aforesaid

Now this present Indenture Witnesseth that for and in consideration of the sum of Eight Hundred Pounds of current money of the said Island of Saint Christopher to them the said Jedediah Kerie Edward Peters and John Mahon in hand well and truly paid by the said John Phipps the receipt of which said sum of Eight Hundred Pounds current money aforesaid is hereby duely acknowledged they the said Jedediah Kerie Edward Peters and John Mahon Hath granted bargained sold aliened released enfeoffed and confirmed and by these presents Doth grant bargain sell alien release enfeoffe and confirm unto him the said John Phipps and his Heirs All that piece or parcel of land hereinafter particularly mentioned and described scituate lying and being in the said Town of Old Road and now in the immediate tenure and occupation of him the said John Phipps vizt. Six several lots of land four of which were formerly in the possession of Drewry Ottley Senior Esquire deceased and the other two formerly in the possession of William Julius Senior deceased the whole of which said Six Lotts of land are now in one lott and abutted and bounded as follows Vizt.

To the Southward from the south corner of Old Street extending west as far as land belonging to the Right Honourable the Lord Romney Westwardly with the said land and other land of the said Lord Romney and so runs along with a Garden Wall as far as upper Common Path leading to the River Northwardly from the corner of the said Garden Wall runs Eastwardly upon a straight line with the said River Path to the north corner of Old Street leading up to land late the property of the said Reverend John Merac deceased and to the Eastward from the said north corner of Old Street upon a strait line to the south corner thereof, or however otherwise the said lott of land is abutted and be made together with all and singular houses and buildings that are thereon standing and lying and all ways paths passages waters watercourses rights easements priviledges profits commodities hereditaments and appurtenances whatsoever with all and singular belonging or in any wise appertaining or therewith or with any part therefrom or at any time heretofore used occupied or enjoyed or accepted reputed deemed taken or known as part parcel or member thereof And the Reversion and Reversions Remainder and Remainders rents issues and profits thereof and of every part and parcel thereof And all the Estate Right Title Interest use trust possession property profit benefit and equity of redemption claim or demand whatsoever which she the said Christina Edmeads in her lifetime ever had or could claim challenge or demand of in and to the said lott of land houses buildings and premisses belonging and every part and parcel thereof and all deeds evidences and writings which were in the custody or possession of her the said Christina Edmeads in her lifetime touching or concerning the same premisses or any part or parcel thereof

To have and to hold the said piece or parcel of land and all and singular other the premisses with their appurtenances and every part and parcel thereof unto the said John Phipps his Heirs and Assigns to the only proper use and behoof of him the said John Phipps his Heirs and Assigns forever

And they the said Jedediah Kerie Edward Peters and John Mahon for themselves their Heirs and Assigns Doth covenant and grant to and with the said John Phipps his Heirs and Assigns that they the said Jedediah Kerie Edward Peters and John Mahon now hath good rightful power and lawful and absolute authority to grant bargain sell release and convey the said piece or parcel of land and all and singular other the premisses with their appurtenances unto the said John Phipps his Heirs and Assigns to the only proper use and behoof of the said John Phipps his Heirs and Assigns forever according to the true intent and meaning of these presents

And Also that he the said John Phipps his Heirs and Assigns shall and may at all times forever hereafter peaceably and quietly have hold use occuppy possess and enjoy all and singular the said piece or parcel of land and premisses with the appurtenances without the Let Trouble Hindrance Molestation Interruption or Denial of them the said Jedediah Kerie Edward Peters and John Mahon their Heirs or Assigns and of all and every other person and persons whatsoever

And that free and clear and freely and clearly acquitted exonerated and discharged or otherwise well and sufficiently saved defended kept harmless and indemnified of from and against all and all manner of former and other bargains sales gifts grants leases mortgages and of and from all other estates rights titles troubles charges and incumbrances whatsoever had made committed done or suffered by them the said Jedediah Kerie Edward Peters and John Mahon or any other person or persons whatsoever claiming or to claim by from or under him them or any of them.

In Witness whereof the said parties first above named have to this present Indenture set their several and respective hands and affixed their several and respective seals the day and year first above written.

To Have and to Hold unto the said John Phipps his Heirs and Assigns forever according to the form and effect of the within Deed.

St. Christophers. Before the Honble Craister Greatheed Esqr. Chief Justice of his Majesty's Court of Kings Bench and Common Pleas for the said Island Personally appeared Richard Oldner who made oath on the Holy Evangelists of Almighty God that he saw the within named Jedediah Kerie Edward Peteres and John Mahon sign seal and as their Act and Deed deliver the within Instrument of Writing and that he also saw the said Jedediah Kerie Edward Peteres and John Mahon sign the Receipt for the consideration money and that he this Deponent subscribed his name as witness thereto.
